Definitions D'essencé.nl,

Customer: the person with whom D'essencé.nl has entered into an agreement.

Parties: D'essencé.nl and customer jointly.

Consumer: a customer who is also an individual and acts as a private person.

Applicability of General Terms and Conditions

These general terms and conditions apply to all quotes, offers, activities, orders, agreements, and deliveries of services or products by or on behalf of D'essencé.nl.

Parties can only deviate from these terms and conditions if they have expressly agreed in writing. Parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the customer or third parties.

Prices

All prices used by D'essencé.nl are in euros, excluding VAT and other costs such as administrative fees, levies, and travel, shipping, or transport costs unless explicitly stated otherwise or agreed upon.

All prices that D'essencé.nl uses for its products or services can be changed at any time. Cost increases of products or parts thereof, unforeseen by D'essencé.nl at the time of the offer or agreement, may lead to price increases. The consumer has the right to terminate an agreement due to a price increase as mentioned in paragraph 3 unless the increase results from a legal regulation.

The price regarding a service is determined by D'essencé.nl based on the actual hours spent. The price is calculated according to D'essencé.nl's usual hourly rates, applicable for the period in which the work is performed unless a different hourly rate is agreed upon.

Payments and Payment Term

The customer must make payments in advance for the product.

Payment terms are considered strict payment terms. If the customer has not paid the agreed amount by the last day of the payment term, they are legally in default and in breach without D'essencé.nl having to send a reminder or notice of default.

Consequences of Late Payment

If the customer does not pay within the agreed term, D'essencé.nl is entitled to charge interest of 1% per month from the day the customer is in default, where part of a month is counted as a full month.

Right of Withdrawal

A consumer can cancel an online purchase within a reflection period of 14 days without giving reasons, provided:

  • The product has not been used.

  • It does not concern a product that can spoil quickly.

  • It does not concern a product specially made or adapted for the consumer.

  • It does not concern a product that cannot be returned for hygiene reasons.

  • The seal is still intact in the case of data carriers with digital content.

  • It does not concern a travel, transport ticket, catering order, or leisure activity.

  • It does not concern a loose magazine or newspaper.

  • It does not concern an urgent repair order.

  • The consumer has not waived his right of withdrawal.

The reflection period of 14 days as referred to in paragraph 1 begins:

  • On the day after the consumer has received the last product or part of one order.

  • As soon as the consumer has received the first product with a subscription.

  • As soon as the consumer has purchased a service for the first time.

  • As soon as the consumer has confirmed that he will purchase digital content via the internet.

The consumer can make his appeal to the right of withdrawal known via info@dessence.nl. The consumer is obliged to return the product to D'essencé.nl within 14 days after notification of his right of withdrawal, failing which his right of withdrawal expires.

Right of Suspension

Unless the customer is a consumer, the customer waives the right to suspend the fulfillment of any obligation arising from this agreement.
